Introduction

Welcome to rootplus.us (the “Website”), operated by Root Plus LLC, an Illinois limited liability company (“Root Plus”, “we”, “us”). By accessing or using the Website you agree to be bound by these terms and conditions (the “Terms”). Please read them carefully: they govern your use of the Website. If you do not agree with these Terms, do not use the Website.

Acceptance of Terms

By accessing and using the Website you accept these Terms in full. If you disagree with these Terms or any part of them, you must not use the Website.

Modifications to the Terms

We may modify these Terms at any time. Changes are posted on this page and take effect when posted; the date above tells you when the page last changed. It is your responsibility to review these Terms periodically. Continued use of the Website after a change constitutes acceptance of the revised Terms.

Use of the Website

Eligibility. You must be at least 18 years old to use the Website. Driving positions we recruit for carry their own legal age and licensing requirements, which are set by law and by the hiring carrier.

Prohibited uses. You agree not to use the Website for any unlawful purpose or in any way that violates the rights of others, including harassment, fraud, defamation, impersonation, submitting information you know to be false, or disseminating harmful content. You agree not to interfere with the operation or security of the Website or to access it by automated means without our permission.

Account registration. Access to the recruiting platform is provisioned by us to staff and to client carriers; there is no public sign-up. If you are given an account, you agree to provide accurate, current and complete information, to keep your credentials confidential, and you are responsible for all activity under your account. Tell us at once through our contact page if you believe your account has been used without your permission.

Communication preferences and consent to text messages

SMS consent. If you tick a text-message consent box on one of our forms and provide your mobile number, you consent to receive text messages from Root Plus of the kind you ticked. We ask for two separate, optional consents: one for conversational and informational messages (a recruiter replying to you, appointment and orientation reminders, document-signing links, and status updates on your application), and one for promotional and marketing messages (driving opportunities, pay or bonus changes, and referral offers). Agreeing to one does not opt you in to the other. Consent to either is not a condition of applying, of being presented to a carrier, or of any purchase.

You may opt out at any time by replying STOP to any message we send; you will receive one confirmation and nothing further. Reply START to opt back in. Reply HELP for assistance, or reach us through our contact page. Message and data rates may apply. Messaging frequency varies with where you are in the hiring process. Opting out may mean we cannot reach you about time-sensitive steps such as an orientation date.

No mobile opt-in or text message consent will be shared with third parties or affiliates. The full programme description is in our SMS Terms of Service.

Privacy

Root Plus is committed to protecting your privacy. Our Privacy Policy explains what personal information we collect, how we use and disclose it, how we store and secure it (including phone numbers provided for text messaging), how long we keep it, and your rights to access, correct and delete it. By using the Website you acknowledge the practices described there. You can request deletion of your information at any time at rootplus.us/data-deletion.

Recruiting and placement services

Placement services are provided to client carriers under individual service agreements, which govern fees, milestones and guarantees. Candidate information provided by Root Plus is confidential and may be used only for the hiring decision it was shared for; hiring a presented candidate outside the agreement to circumvent an agreed placement fee remains fee-eligible under that agreement. The recruiting platform is provided to active clients, and access may be withdrawn when an engagement ends. Where these Terms conflict with a signed agreement between Root Plus and your company, the signed agreement prevails.

Intellectual property

All content, design, text, graphics, logos and images on the Website are the property of Root Plus or its licensors and are protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute or create derivative works from any part of the Website without our prior written consent. Carrier names and marks shown on the Website belong to their respective owners.

Third-party links

The Website may contain links to third-party websites, including carriers' own sites and social-media platforms. They are provided for convenience only. Root Plus does not endorse and is not responsible for the availability, accuracy or content of any third-party website.

Disclaimers

No warranties.The Website and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the information on the Website is accurate or complete, that any particular position is or remains available, or that a placement will result from an application.

Limitation of liability. To the fullest extent permitted by law, Root Plus, its affiliates, directors, employees and agents shall not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Website or its content.

Indemnification

You agree to indemnify, defend and hold harmless Root Plus, its officers, directors, employees and agents from and against any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising from your use of the Website or any breach of these Terms.

Termination

We may suspend or terminate your access to the Website at any time, without prior notice or liability, for any reason, including a breach of these Terms. Provisions that by their nature should survive termination, including the intellectual property, disclaimer, limitation of liability and indemnification sections, survive.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute relating to these Terms is subject to the exclusive jurisdiction of the state and federal courts located in Illinois.
